1Definitions
Personal Data means information that identifies an individual or relates to an identifiable individual. Local laws sometimes use terms such as “personal information” or “personal data.” This Privacy Policy uses “Personal Data” to cover those concepts.
Customer Data means data submitted to the Services by or for a Customer, including Personal Data processed by Elements on the Customer's instructions.

We collect Personal Data about:
- Website visitors
- Customer users and authorised users
- Customer employees and contractors
- Customer vendors, suppliers, and clients
- People who contact us
- Event attendees and webinar registrants
- Job applicants and candidates
- Representatives of partners, suppliers, and service providers
3How We Collect Personal Data
We collect Personal Data through:
Direct Collection
You submit Personal Data through forms, email, phone, meetings, demos, surveys, events, or account setup.
Website Interactions
Your browser and device send technical and usage information when you use the Website.
Customer Use of Services
We receive and process Customer Data through the Services as configured by the Customer, including through integrations.
Third-Party Systems and Tools
We receive Customer Data through third-party services connected by Customers, including through APIs and similar integration methods.
Social Media and Partners
We collect Personal Data you share with us through social media interactions, and receive Personal Data from business partners, resellers, referral partners, data providers, and marketing partners.
4Types of Personal Data We Collect
4.1 Contact details
Name, business email, phone number, company name, job title, department, and business address.
4.2 Account and identity details
Usernames, passwords, authentication factors, role and permission settings, and profile details.
4.3 Product and usage details
User activity logs, feature usage, actions taken, timestamps, configuration settings, and workflow history.
4.4 Device and network details
IP address, browser type, device type, operating system, language settings, and approximate location.
4.5 Transaction and billing details
Billing contact details, invoice references, subscription plan details, payment status, and transaction metadata. Payment card and bank details are processed by payment providers. We do not store full payment card numbers.
4.6 Customer Data Processed Through the Services
Depending on Customer configuration, Customer Data can include financial and accounting records, vendor and client records, invoice and receipt data, transaction histories, ledger details, approvals, notes, and supporting documents.
4.7 Communications
Support tickets, emails, chat messages, call notes, recordings where notice is given, and feedback.
4.8 Recruitment and Job Applicant Data
CV or resume data, work history, education, qualifications, languages, interview notes, assessment results, references where provided, and right-to-work information as required by law.
6How We Use Personal Data
6.1 Provide and Operate the Website and Services
Account creation, authentication, access management, features, support, service delivery, and product operations.
6.2 Customer Administration and Support
Customer onboarding, account management, support services, troubleshooting, training, notices, and updates.
6.3 Communications
Respond to inquiries, send operational messages, and deliver service notices.
6.4 Billing and Payments
Subscriptions, invoicing, billing administration, payment processing, and collections for overdue amounts.
6.5 Security and Abuse Prevention
Prevent unauthorised access, monitor for fraud and misuse, investigate incidents, and protect systems and users.
6.6 Product Improvement and Development
Service analytics, quality assurance, debugging, research, and development of new features.
6.7 AI-Enabled Features
Where Services include AI functionality, we process Customer Data submitted to AI features to generate outputs and improve performance of those features. We treat AI inputs and outputs as Customer Data.
6.8 Legal Compliance
Comply with legal obligations, respond to lawful requests, enforce agreements, and protect rights and safety.
6.9 Marketing
Send product updates, event invitations, and promotional communications in line with your preferences and applicable law.
6.10 Aggregation and De-Identification
We create aggregated or de-identified datasets from Personal Data and service usage data for analytics, benchmarking, security analysis, and business planning. De-identified data does not identify you.
7Legal Bases for Processing (EU and UK)
Where EU or UK law applies, we rely on these legal bases:
- Contract — processing needed to provide the Website or Services, or to take steps before entering a contract
- Legitimate interests — operating and improving our business, securing the Services, preventing fraud, customer support, and marketing to business contacts
- Consent — where required by law, including certain marketing communications and certain cookie use
- Legal obligation — processing required to meet legal and regulatory requirements
9International Transfers
We operate globally. Personal Data is processed in countries where we or our providers operate. Where EU or UK law applies and transfers occur outside the EU or UK, we use approved transfer mechanisms, such as Standard Contractual Clauses and the UK Addendum where relevant.
10Data Retention
We keep Personal Data for as long as needed for the purposes in this Privacy Policy, including providing the Services, meeting legal, tax, accounting, and compliance duties, resolving disputes, enforcing agreements, and maintaining security logs.
When retention is no longer needed, we delete, anonymise, or securely destroy data, subject to legal retention duties and backup cycles.
11Your Rights and Choices
11.1 General Rights
Depending on where you live, you can request:
- Access to your Personal Data
- Correction of inaccurate Personal Data
- Deletion in certain cases
- Restriction of processing in certain cases
- Objection to processing in certain cases
- A portable copy of your Personal Data in certain cases
- Withdrawal of consent where processing relies on consent
We verify identity before responding. If your request relates to Personal Data processed on behalf of a Customer, submit your request to the Customer directly.
11.2 Communication Preferences
You can opt out of promotional emails through the unsubscribe link, or by emailing us. Service and security notices continue regardless.
12Security
We maintain administrative, technical, and physical safeguards designed to protect Personal Data against unlawful or unauthorised access, alteration, disclosure, or destruction. No system offers complete security. You should protect account credentials and use strong authentication.
13EU and UK Information
13.1 Roles
For Website interactions and recruiting, Elements acts as a controller. For Customer Data processed through the Services, Elements acts as a processor and processes data on Customer instructions, under the Services Agreement and any data processing terms.
13.2 Rights
EU and UK individuals have rights described in Section 11, including the right to lodge a complaint with a supervisory authority. UK residents can also complain to the Information Commissioner's Office.
14United States State Privacy Rights
14.1 California
Where California law applies, you have rights including:
- Right to know categories of Personal Data collected, used, and disclosed
- Right to access specific pieces of Personal Data
- Right to delete Personal Data in certain cases
- Right to correct inaccurate Personal Data
- Right to opt out of sale or sharing where applicable
- Right to non-discrimination for exercising privacy rights
We do not sell Personal Data in exchange for money.
14.2 Virginia
Where Virginia law applies, you have rights including access, correction, deletion, portability, opt out of targeted advertising, and right to appeal a denial of your request.
